Sweden and Germany have been notified by a ‘letter of formal notice’ from the European Commission about infringement proceedings over their nation’s legislations that restrict the online gambling services offered to them. These nations must respond to the official notice within two months. If the countries fail to show valid reasons that online gambling and poker sites are unlawful and not within the laws of the European Commissions Treaty the cases will be brought to the European Court of Justice.

The European Commission states that horse race betting on the internet is not prohibited in Germany and marketing for “games of chance” are not prohibited on the radio, through the mail and by the press. Germany has banned advertising for online gambling sites as well as banks conducting financial transactions for them.

In Sweden, Svenka Spel is a state run poker room. The European Commission points out the irony that that Sweden can’t promote the game of poker while banning foreign gaming businesses from offering their services to Sweden.
